The European Data Act (Data Act) will come into force on 12 September 2025. This European law requires us to inform consumers in advance about the data collected by connected devices, such as smart devices. Examples include robot vacuum cleaners, smartwatches (or other fitness equipment), smart lighting (controllable via an app) or other household appliances with an internet connection (including washing machines, baby monitors, scales, doorbells, thermostats or refrigerators). As a seller, we are obliged to display this information and ask you to provide it.
What does the Data Act entail?
The Data Act is a new European law that focuses on data sharing. The law focuses on data collected by connected devices, such as smart devices with an internet connection. The aim of the Data Act is to make this data more accessible to users, i.e. customers, so that they have more insight into and control over the data generated by their devices.
What does this mean for you?
We need the information from you in order to show it to customers, so we expect you to provide this content. We offer a template that you can use for this purpose. Use of this template is not mandatory, but it can help you meet the requirements quickly and easily. Of course, you may also upload a document from the manufacturer containing the necessary information.
What information is required?
To comply with the Data Act, you are legally required to provide the following information:
- The type, format and volume of data that the item can generate
- Whether the item can generate data continuously and in real time
- Whether the item stores the data on the device itself or on an external server (including the retention period)
- How the user can consult, request or delete the data, including the manner in which this can be done, terms of use and the quality of the service
How do I provide the required product information for the EU Data Act?
To add the EU Data Act product information to your products, copy the following fields one‑to‑one into your content feed. It is important to copy these fields exactly into your feed, as the content feed is in Dutch::
- Verkrijgt of genereert dan wel verzamelt data
- Informatie datagebruik document
For the field “Verkrijgt of genereert dan wel verzamelt data” you can use the value “Ja” or “Nee.” For the field “Informatie datagebruik document” you can use a URL in the content feed. You can also use the online content editor for this. On this page you can find how to do this in the supplier portal. In the content editor, fill in the values for the fields above to complete the EU Data Act product information for your products.
